Under the authority granted by ministerial regulations issued by the Ministry of Agriculture and Cooperatives and to promote sustainable management of fisheries resources, including compliance with measures for controlling and balancing the utilization of aquatic resources, the Department of Fisheries hereby establishes criteria and conditions for granting permission to modify fishing gear specified in commercial fishing licenses as follows:
1. Criteria for Permission
1.1 The applicant must hold a valid and active commercial fishing license that has not been revoked.
1.2 The modification of fishing gear in the license must comply with the law and adhere to the fishing gear permitted in each fishing zone as specified by the Department of Fisheries.
1.3 Such modifications must not cause any adverse impacts on aquatic resources, the environment, or ecosystems within the fishing zone.
2. Procedures and Required Documents
2.1 Submit an application at the provincial fisheries office or another office designated by the Department of Fisheries.
2.2 Attach the following documents:
A copy of the commercial fishing license.
The application form for modifying fishing gear (as per the form specified by the Department of Fisheries).
A schematic diagram showing the characteristics of the fishing gear to be modified.
Proof of payment of fees as prescribed by law.
2.3 The Department of Fisheries will evaluate the application for appropriateness and notify the applicant of the decision within 30 days.
3. Conditions for Permission
3.1 The modification of fishing gear must be completed within the timeframe specified by the Department of Fisheries.
3.2 If any conditions are violated, or if it is found that the modification causes adverse impacts on natural resources, the Department of Fisheries reserves the right to revoke the permission without prior notice.
3.3 The permission to modify fishing gear does not exempt the license holder from obligations under other relevant laws.
This announcement shall take effect from January 1, B.E. 2567 (2024) onwards.
